WIN WITH HAYDEN QUINN SOUTH AFRICA WEEKLY COMPETITIONS – TERMS AND CONDITIONS

Introduction

  1. The Hayden Quinn South Africa Weekly Competitions (“the weekly competitions”) will be run by Cardova Trading (Pty) Ltd and its associated entities in association with:

  • Avios Group (AGL) Limited (Reg. No. 2260073 (England and Wales));

  • SafariNow.com (Pty) Ltd (Reg. No. 2000/009927/07);

  • Woolworths (Pty) Ltd (1956/000518/07); and

  • Nedbank Limited (Reg. No. 1951/000009/06).

(collectively “the organisers”)

  1. All persons entering the weekly competitions (“the entrants”) agree that the weekly competitions rules as set out in these terms and conditions are binding on them.

  2. The organisers will run 12 consecutive weekly competitions during the period from Monday, 14 July 2014 until Sunday, 5 October 2014.

Competition Periods

  1. Each weekly competition will be announced during the Hayden Quinn South Africa episode on SABC 3 and will commence at 21h30 each consecutive Monday, with first weekly competition commencing on 14 July 2014 and will close at 24h00 on each following Sunday (“the weekly competitions period”). E.g the first weekly competition will commence at 21h30 on Monday, 14 July 2014 and will close at 24h00 on Sunday, 20 July 2014, the second weekly competition will commence at 21h30 on Monday, 21 July 2014 and will close at 24h00 on Sunday, 27 July 2014 and so forth, with last of the 12 weekly competitions commencing at 21h30 on Monday, 29 September 2014 and closing at 24h00 on Sunday, 5 October 2014.

Automatic consecutive entries

  1. By entering one of the weekly competitions, the entrant shall automatically be entered for each following and remaining weekly competitions as well.

Who can enter

  1. In order to be eligible to enter the weekly competitions:-

    1. the entrant must be a legal resident of South Africa and be in possession of a valid identification document with an 13 digit identity number;

    2. the entrant must permanently reside in South Africa;

    3. the entrant must be 18 years or older;

    4. the entrant must hold a valid South African driver’s license, which must be valid for the period when the prize is utilized, unless, if determined as the winner, the entrant chooses not to utilise the Avis car rental portion of the weekly prize (if applicable);

    5. the entrant cannot be a juristic person and must be an individual person;

    6. the entrant must have the right to accept the prize.

  2. Notwithstanding clause 6 above, the weekly competitions is not open to any person who is a director, member, partner, employee or agent of, or consultant to any of the organisers or any other person who directly or indirectly controls, or is controlled by, any of the organisers, including their spouses, life partners, parents, children, brothers, sisters, business partners and associates, or any supplier of goods or services in connection with the weekly competitions .

How to Enter

  1. To enter the weekly competitions the entrants must:-

    1. complete all the mandatory fields located on the weekly competition entry form and submit the entry form, which is found on www.HaydenQuinnSouthAfrica.com;

    2. accept these terms and conditions;

  2. By entering the weekly competitions, each entrant warrants that all information included on his/her entry is true and correct. Entrant will be disqualified should the organisers find that information is untrue or incorrect.

  3. Only entries received during the weekly competition period will be accepted and considered.

  4. Each person may enter only once for the weekly competitions, and will automatically be entered for all the remaining weekly competitions.

How the winner is determined

  1. The winner will be drawn by means of an automated system from the entries received during the weekly competition periods on or by each consecutive Monday following the commencement of that weekly competition, with the first draw taking place on Monday, 21 July 2014 and so forth, with the last draw taking place on Monday, 6 October 2014.

  2. The winner will be announced on the Expresso, SABC 3 television programme (which is broadcast between 6h00 and 8h30 every weekday on SABC 3) on every Tuesday following the Monday draw for each weekly competition. The winner’s details will further be placed on www.HaydenQuinnSouthAfrica.com following each winner announcement.

  3. The organisers will also contact the winner telephonically on the telephone number provided by the winner on his/her entry.

  4. In the unlikely event that the winner is not contactable by the organisers within 5 business days from the announcement of the winner as provided in 13 above, and provided that the organisers made all reasonable efforts to contact the winner before this date, the winner shall forfeit the prize and the organisers will be entitled to draw a different winner on the same conditions, except that the organisers will make only one attempt to contact each further name selected until a winner is confirmed.

  5. Should the entrant be determined as the winner, he/she undertakes to expeditiously provide such information and documentation required to confirm eligibility to enter the weekly competitions and as may be required in order to facilitate receipt the prize and to sign receipt of the prize upon its receipt.

The Prize

  1. The prizes for the weekly competitions shall be as described in the prize description page on the competition entry page for each weekly competition, and shall further be subject to the following terms and conditions:

    1. If any flights are offered as part of the prize for any weekly competition, such flights are offered subject to the following:

      1. flights are provided only from and back to any of the following major airports in South Africa – Johannesburg, Cape Town, Durban and Port Elizabeth;

      2. flights are provided subject to the prevailing standard terms and conditions for carriage as promulgated by the selected Airline;

      3. flights are provided inclusive of airport taxes;

      4. flights exclude any charges for overweight (if applicable).

      5. transport to and from the initial departing airport are for the winner’s own account;

      6. in the event that the destination airport is the closest major airport to the permanent residence of the winner, the flights are excluded from the prize.

    2. If any vehicle rental is offered as part of any of the weekly competition prizes:-

      1. such vehicle rental shall be subject to the standard terms and conditions as promulgated by the vehicle rental provider; and

      2. such vehicle rental shall exclude any fuel consumption and/or applicable insurance.

  2. The prizes and/or any part thereof, provided in terms of any of the weekly competitions are non-transferrable and cannot be deferred or exchanged for cash or equivalent.

  3. The organizers and their agents shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with this competition or accepting or using the prizes.

General

  1. The organisers reserve the right to modify or amend the terms and conditions as well as to terminate the weekly competitions at any time if it is deemed necessary in their opinion. In the event of such termination, all entrants agree to waive any rights that they may have in terms of the weekly competitions and acknowledge that they will have no recourse against the organisers, their agents and/or suppliers.

  2. The organizers and their agents accept no responsibility for any problems or technical malfunction of any communication network or any late, lost incomplete, misdirected, incorrectly submitted, delayed, illegible, incomplete or corrupt entries. The organizers and their agents are not liable for any costs incurred, responses received or any other consequences of user error.

  3. The organisers’ decision regarding any matter concerning the weekly competitions and/or arising out of these terms and conditions, including the determination of the winner, is final and no correspondence will be entered into. The organizers or their agents will not be held responsible for any disputes arising from the weekly competitions or prize awards.

  4. By entering this competition or communicating with the organisers by electronic means, the entrant consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be “in writing”.

  5. The entrant’s information will be treated as confidential and will, subject to paragraph 25, not be disclosed to third parties except in situations where:

    1. the organisers are legally compelled to do so;

    2. Disclosure is made at the entrant’s request or upon the entrant’s written consent; or

  6. Notwithstanding paragraph 24 above, the entrant agrees that by accepting the terms and conditions for this competition, the entrant also agrees to the organisers collecting, processing and storing the information provided by the entrant on the entry form to use for purposes of this competition and that the organisers may use such information to provide the entrant with marketing information. The entrant agrees to the organisers sharing his/her name and email address with the sponsors of the competitions to use for marketing purposes.

Important Notice

  1. The entrant acknowledges that by submitting his/her entry to the weekly competitions he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.

  2. All entrants to the weekly competitions participate entirely at their own risk.  By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the organisers and all their associated entities and the SABC, including their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the weekly competitions and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or willful misconduct of any indemnified party.

Win With Hayden Quinn South Africa Grand Prize Competition (“the grand prize competition”)

  1. The entrant will also be entered into the draw for the grand prize competition if he/she selects to be entered into the grand prize competition and by either agreeing to join the Avios Travel Rewards Programme as provided for on the entry form, if the entrant is not already a member, or if the entrant is already an Avios Travel Rewards Programme member, by answering “yes” to being an existing Avios member or an Avios card holder on the relevant field on the entry form.

  2. The entry to the grand prize competition shall be subject to the specific terms and conditions for the grand prize competition.

  3. The entrant agrees to read the terms and conditions, and more specifically the requirements for eligibility to enter, for the grand prize competition before selecting to be included in the grand prize competition draw.
